Warranty
Our Warranty is that on delivery and for the relevant Warranty Periods (set out below) the Goods shall be free from material defects in design, material and workmanship.

If you notify us during the relevant Warranty Periods within a reasonable time of discovery that some or all of the Goods do not comply with Our Warranties, we shall, at our option, repair or replace the individual faulty component of the Goods or refund the price of the faulty Goods in full. In order to be validated a proof of purchase (invoice or receipt) must be supplied to us with any returned item where it is claimed that some or all of the Goods do not comply with Our Warranty.

All Dellonda products are covered by a minimum 1-year warranty (“the Warranty”) (unless otherwise specified). This warranty covers against manufacturing defects and excludes general wear and tear and any serviceable/consumable items.
Garden Furniture
Our 3-year warranty (the “Structural Warranty”) covers furniture for structural failure (framework) and rust in the UK. The Structural Warranty applies to all garden furniture sold by Palladium Ltd and/or Dellonda Ltd. The Structural Warranty does not include glass, cushion fabric and filling, or stitching supplied with sets.
The furniture design is specified and constructed to withstand normal weather conditions in the UK, and therefore may not be suitable for foreign climates. Extreme temperatures may cause weaved products to contract and expand, consequently leading to damage or cracking. Should the consumer wish to move furniture outside of the UK, Palladium Ltd and/or Dellonda Ltd is not liable for any consequent damage, caused by foreign weather conditions.

The Warranty and Structural Warranty do not cover damage caused by extreme weather conditions. We recommend that garden furniture is covered or stored inside when not in use or during the colder months.
Palladium Ltd and/or Dellonda Ltd reserves the right to void the Structural Warranty in cases where it is deemed that the product has been subjected to inappropriate use or in instances where the product has been tampered with. The Warranty or the Structural Warranty does not apply to fair wear and tear.
The Structural Warranty’s 3-year term is the maximum period covered and any replacement items provided do not re-start the guarantee period. All Warranties begin from the date of dispatch to the consumer.
Spas, Hot Tubs And Swimming Pools
All Dellonda spas, hot tubs and swimming pools are supplied with a 1-year warranty which covers electrical components, hoses and accessories. Liners and covers are covered by a 6-month warranty.

Products must be used in accordance with the instructions provided.

For reasons of hygiene, hot tubs and swimming pools returned to us must be clean and dry regardless of the type of the warranty claim. Failure to observe this request this will result in the immediate return of the product.

All warranty claims are subject to product assessment and testing on receipt. Control units have a 12-month warranty, subject to correct use. Covers and liners have a 6-month warranty and will be replaced if punctures or defects are present due to a manufacturing or material fault.
Graded Items
Products sold by Palladium Ltd and/or Dellonda Ltd as Graded, Refurbished or Open Box are covered with a 6-month warranty. If a fault develops during this time, Dellonda will attempt to repair the item. Replacement products supplied under the terms of this warranty will usually be a graded item but may sometimes be in new condition at Palladium Ltd and/or Dellonda Ltd’s discretion. In this case the replacement item will be covered with a 6-month warranty.
Transit Of Goods
You are responsible for the safe return of the faulty Goods. We will collect faulty Goods from your premises during normal working hours. You are responsible for the packaging of the returned Goods – please make sure the Goods are properly packed for transportation. We will ensure that returned goods are properly packed for return transit to you.
Loss Or Damage
Except as provided in this Warranty Statement, we shall have no liability in respect of the Goods that do not comply with Our Warranty.
Except as set out in these Terms, all warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from this warranty.
Liability
Nothing in these Terms shall limit or exclude our liability for:

death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors (as applicable);

fraud or fraudulent misrepresentation;
-
breach of the terms implied by section 12 of the Sale of Goods Act 1979;
-
defective products under the Consumer Protection Act 1987; or
-
any matter in respect of which it would be unlawful for us to exclude or restrict liability.
Subject to the above statement we shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any:
loss of profit, loss of business, loss of contract or loss of goodwill;
or for any indirect or consequential loss in each case arising under or in connection with the Warranty; and
our total liability to you in respect of all other losses arising under or in connection with the Warranty, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the price of the Goods in connection with which a claim arises.
